APPLICATION OF THE GENERAL CONDITIONS OF SALE
The general conditions of sale detailed below apply to all orders for products placed on the website www.melfair.shop. The customer must take note of the general conditions of sale before any order, the CGV being available on the site. The company MelFair Oliveira Dos Santos reserves the right to adapt or modify at any time the present GTC, the version of the GTC applicable to any sale being the one appearing online on the site www.melfair.shop at the time of the order. Consequently, the fact of placing an order requires the whole preliminary adhesion and, without reserve, with these CGV by the customer while clicking on the button “I read and I accept the general conditions of sale”.
SITE INFORMATION AND ACCESSIBILITY
www.melfair.shop is an e-commerce site owned and operated by Melissa Dos Santos. The site is open to all users of the Internet network and is in principle accessible 24 hours a day, 7 days a week, except in the event of interruption, whether scheduled or not, by Melfair or its service providers, for the purposes of maintenance or in the event of force majeure (as defined herein). MelFair shall not be liable for any damages of any kind resulting from the unavailability of the site. MelFair does not warrant that its site will be free of defects, errors or bugs, or that the site will operate without failure or interruption. In this regard, he may freely determine at his own discretion any period of unavailability of the site or its content. MelFair cannot be held responsible for data transmission problems, connection problems or network unavailability.
REGISTRATION ON THE SITE
In order to place an order, the customer must first register on the site by creating an account containing the customer’s information. The customer’s registration on the site is validated by the MelFaiir team after checking the standard form filled in by the customer. The customer receives an e-mail confirmation of registration. When creating an account, the customer must ensure the accuracy and completeness of the data provided. The customer is obliged to keep his personal information up to date. In case of error in the wording of the recipient’s coordinates, MelFair cannot be held responsible for the impossibility of delivering the products. By registering on the site, the customer declares and guarantees to MelFair that he/she is of age and has the legal capacity to contract. MelFair may delete Customer’s account at any time, for any reason, in its sole discretion.
DATA PROTECTION AND INTELLECTUAL PROPERTY
In Switzerland, personal data is protected by the Federal Law on Data Protection (LFD of June 19, 1992 – status January 1, 2014). All elements of the MelFair website are and remain the exclusive intellectual property of MelFair. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software or visual. The content of the www.melfair.shop website, including texts, graphics, photos and other illustrations of any kind, is protected by trademark law. Any use of the MelFair brand and/or logo in any form or manner whatsoever is prohibited without the prior written consent of the author.
PERSONAL DATA
The information requested from the buyer is necessary to process his order and may be communicated exclusively to MelFair’s contractual partners involved in the execution of this order. The buyer is solely responsible for the access and use of the means of access (user name, password) which are communicated to him at the end of the registration process. He is solely responsible for the consequences that may result. The personal data of the buyer communicated to MelFair are treated confidentially. MelFair undertakes never to pass them on to a third party.
ITEM DESCRIPTION
The items offered for sale on the site www.melfair.shop are described and presented with the greatest accuracy. If errors occur, MelFair cannot be held responsible for them. The photos representing the articles are only indicative.
ORDER
The customer can select as many products as he wants to add to the cart. The basket summarizes the products chosen by the customer as well as the prices and the related costs. The customer will be able to freely modify the basket before validation of his order. The validation of the order is confirmation of the acceptance by the customer of the GTC, the products purchased, their price and the associated costs. A confirmation email summarizing the order (products, prices, availability of products, quantity…) will be sent to the customer by MelFair. To this end, the customer formally accepts the use of electronic mail for the confirmation of the contents of his order. Invoices are available in the “my account” section of the site. MelFair reserves the right to refuse the purchase offer if the desired product is out of stock.
PRICE AND PAYMENT TERMS
The prices mentioned are displayed in Swiss francs including VAT or in euros excluding VAT. They do not include delivery charges or other possible taxes such as customs duties, payment of various duties or taxes that must be paid by the buyer. MelFair reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of the recording of the order, subject to availability. The price is due at the time of order. The buyer can pay his order by credit card (Visa, Mastercard or PostFinance).
DELIVERY
MelFair delivers anywhere in Switzerland within 3-7 working days. MelFair is not responsible for any damaged or lost items during delivery. This last one is carried out by the post office with tracking number at the address indicated by the purchaser at the time of his order. Delivery is made to the delivery address indicated by the customer, it being specified that this address must be the residence address of the customer, of a natural person of his choice or of a legal entity (delivery to his company). Delivery cannot be made to hotels or post office boxes. Otherwise, the product will be returned to MelFair’s warehouse.
RIGHT OF RETURN AND REFUND
The buyer is allowed to return the ordered item to MelFair within 15 days after receiving the order. The return must be made according to the return policy on www.melfair.shop, that is to say by including the return form to your package. It is preferable to inform us beforehand of your wish to return by e-mail at the following address: contact@melfair.ch. The return of the product takes place under the responsibility of the buyer. Concerning the expenses of return, they are with the load of this one. MelFair then undertakes to reimburse the value of the article to the buyer as soon as possible and provided that Melfair has been able to recover the intact products, initially delivered. MelFair will make the refund using the same payment method as the one used for the transaction. MelFair does not accept the return of non-defective items that have been worn, used and/or without their original pouch. APPLICABLE LAW AND JURISDICTION
Any dispute in connection with the use of the website www.melfair.shop is subject to Swiss law. These terms and conditions are subject to Swiss law and in particular to the Swiss Code of Obligations, which regulates those aspects not expressly mentioned in these terms and conditions. This is true for both substantive and formal rules. In case of dispute or claim, the buyer will address in priority to MelFair to obtain an amicable solution.
